Terms and Conditions of Sale

These Terms and Conditions of Sale govern the contractual relationship between Brutal Studio and its clients for any original photographic creation and transfer of copyright.

Article 1 – Author

Brutal Studio – Christian Dubois, sole proprietorship. SIREN: 101 311 504 – SIRET: 101 311 504 00019. APE code: 7420Z. Address: 93400 Saint-Ouen-sur-Seine, France. Author-artist registered with URSSAF Limousin under the author-artist scheme (Article L.382-1 of the French Social Security Code).

Article 2 – Creations Offered

Brutal Studio offers photographic creation sessions including:

  • A 90-minute photographic creation session in studio
  • Art direction and posing coaching
  • 10 retouched high-definition photographic works (Signature Session) or all retouched photographic works (Signature+ Session)
  • Digital delivery within 5 business days
  • Transfer of exploitation rights for personal and professional materials (reproduction, representation, adaptation) under the terms of this transfer

Article 3 – Pricing and Payment

Two plans are available: Signature Session at €349 net of tax (10 retouched photographic works) and Signature+ Session at €649 net of tax (all photographic works retouched).

Signature Session clients can upgrade to the Signature+ Session for €300 net of tax.

Payment is made online by credit card through a secure platform at the time of booking.

The booking is confirmed upon receipt of full payment.

VAT not applicable, Article 293 B of the French General Tax Code.

Article 4 – Booking and Confirmation

Booking is done online through our appointment system. A confirmation email with session details is sent after payment.

Article 5 – Rescheduling and Cancellation

Rescheduling by client:

Any rescheduling request made at least 72 hours before the session entitles the client to one free rescheduling. The new session must take place within six months of the originally scheduled date. If the request is made less than 72 hours before the session, no rescheduling will be granted.

Cancellation by Brutal Studio:

If Brutal Studio is unable to deliver the photographic creation due to force majeure or any other reason beyond its control, a new time slot will be offered to the client or, failing agreement, a full refund will be made.

Article 6 – Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for clearly personalized works made to the client's specifications, nor for creations to be carried out on a specific date or period.

Consequently, any confirmed booking for a photographic creation session on a fixed date is firm and final. No refund will be granted after confirmation of the booking, which binds the client firmly.

This exclusion applies from the confirmation of the booking and full payment of the creation.

Article 6 bis – Gift Voucher

  • The gift voucher is non-refundable.
  • It is valid for 1 year from the date of purchase.
  • It is transferable to a third party.
  • After the validity period, the gift voucher is forfeited without possibility of refund or exchange.
  • The gift voucher code must be provided at the time of booking and will be deducted from the total amount of the creation.

Article 7 – Carrying Out the Creation

The session takes place at Brutal Studio in Saint-Ouen, at the agreed date and time.

The client agrees to be punctual. A delay of more than 15 minutes may result in a reduced session time without compensation.

The retouched photographic works are delivered via secure download link within 5 business days after the session.

Article 8 – Intellectual Property

The photographic works are original works of the mind within the meaning of Articles L.111-1 and L.112-2 of the French Intellectual Property Code. The copyright remains the property of the author, Brutal Studio – Christian Dubois.

The client benefits from a non-exclusive transfer of exploitation rights for personal and professional use (social media, website, portfolio, CV, print materials).

Any use of the works beyond the rights expressly transferred herein requires the author's prior consent and will be subject to additional remuneration.

The author's moral right is inalienable and imprescriptible in accordance with Article L.121-1 of the French Intellectual Property Code. The client agrees to respect the integrity of the works. Crediting “Brutal Studio — Christian Dubois” is appreciated but not mandatory.

Brutal Studio reserves the right to use the works for promotional purposes (portfolio, social media, website), unless the client objects in writing.

Article 9 – Liability

The client is responsible for the information provided and their preparation (outfits, accessories).

Brutal Studio commits to creating a professional photographic work in line with the description provided.

Brutal Studio cannot be held liable in cases of force majeure (illness, accident, extreme weather for outdoor sessions).

Article 10 – Disputes and Applicable Law

These Terms are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action. The client may use a consumer mediator free of charge.

Failing agreement, French courts shall have sole jurisdiction.

Article 11 – Acceptance of Terms

Validating the booking implies full acceptance of these Terms and Conditions.
